IMPORTANT: PLEASE READ THESE TERMS CAREFULLY BEFORE USING SECRETDROP.DEV. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.
If you do not agree to these Terms, you must not use the Service.
1. Definitions
- "Service" refers to the SecretDrop.dev website, web application, APIs, and any related services.
- "Operator", "we", "us", or "our" refers to the owner and operator of SecretDrop.dev.
- "User" refers to any individual or entity accessing or using the Service.
- "Content" refers to any files, text, data, secrets, configuration files, or other material uploaded, transmitted, or accessed via the Service.
2. Description of Service
SecretDrop.dev provides a secure file and secret-sharing platform that allows users to upload encrypted bundles protected by passwords and share them via public links.
The Service is provided strictly on an "as-is" and "as-available" basis without warranties of any kind.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.
3. Eligibility
You must be at least 18 years old and legally capable of entering binding contracts to use this Service.
By using the Service, you represent and warrant that you meet these requirements.
4. Account Responsibility
Users are solely responsible for:
- Maintaining the confidentiality of their login credentials
- All activity under their account
- All passwords created for bundle protection
- Secure transmission of passwords to recipients
We are not responsible for unauthorized access resulting from user negligence.
5. User Content and Responsibility
You retain full ownership of any Content you upload.
However, you are solely responsible for:
- The legality of your Content
- Ensuring you have the right to upload and share it
- Compliance with all applicable laws and regulations
- Ensuring Content does not violate intellectual property, export laws, privacy laws, or sanctions regulations
You agree NOT to upload:
- Illegal content
- Malware or harmful code
- Content related to exploitation, abuse, or criminal activity
- Content violating export control or sanctions laws
- Content infringing intellectual property rights
We reserve the right (but have no obligation) to remove any Content at our sole discretion.
6. Encryption and Security Disclaimer
SecretDrop.dev implements encryption mechanisms designed to protect user Content. However:
- No system is completely secure.
- We do not guarantee absolute security.
- We do not guarantee protection against unauthorized access, cyberattacks, or data breaches.
- We do not warrant that encryption mechanisms are error-free or immune to compromise.
Users assume all risk associated with uploading and transmitting sensitive information.
The Service is not intended for classified, regulated, or mission-critical data.
7. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" and "as available".
- We disclaim all warranties, express or implied.
- We shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes, without limitation:
- Loss of data
- Loss of secrets
- Unauthorized access
- Business interruption
- Lost profits
- Reputational damage
- Security breaches
- Failure of encryption
- Account lockout
- Policy-based deletions
Our total aggregate liability shall not exceed the total amount paid by you to the Service in the twelve (12) months preceding the claim.
If you have not paid for the Service, our total liability shall not exceed one hundred (100) EUR.
8. Data Loss and Deletion
Bundles may be automatically deleted due to:
- Expiration policies
- Download limits
- Failed password thresholds
- Account termination
- System cleanup processes
We are not responsible for any data loss, whether accidental or intentional per policy configuration.
Users are solely responsible for maintaining backups.
9. Payments, Subscriptions, and Refunds
All purchases, subscriptions, upgrades, and lifetime licenses are FINAL.
NO REFUNDS WILL BE PROVIDED UNDER ANY CIRCUMSTANCES.
This includes:
- Partial billing periods
- Accidental purchases
- Failure to use the Service
- Account termination
- Dissatisfaction
- Technical issues not caused by willful misconduct
By purchasing a subscription or lifetime plan, you expressly waive any right to refund to the maximum extent permitted by law.
We reserve the right to change pricing at any time.
10. Termination
We may suspend or terminate accounts at our sole discretion, without notice, for any reason, including suspected abuse, violation of these Terms, or legal risk.
Upon termination:
- Access may be revoked immediately
- Bundles may be deleted
- No refunds will be issued
11. Analytics
We use Rybbit as a privacy-focused, no-cookie analytics provider.
Rybbit does not use tracking cookies and does not perform invasive behavioral profiling.
Analytics data is collected in anonymized or privacy-preserving form for operational and performance monitoring purposes.
By using the Service, you consent to such analytics processing.
12. No Professional Warranty
SecretDrop.dev is not a certified security product, compliance solution, or regulated vault.
We make no representation that the Service satisfies:
- GDPR compliance requirements for your specific use case
- HIPAA
- SOC 2
- ISO certifications
- Government security standards
Users are solely responsible for determining fitness for purpose.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Operator from any claims, damages, liabilities, losses, costs, and expenses (including legal fees) arising out of:
- Your use of the Service
- Your Content
- Violation of these Terms
- Violation of any law or third-party rights
14. Force Majeure
We shall not be liable for failure or delay caused by events beyond our reasonable control, including but not limited to:
- Natural disasters
- Cyberattacks
- Infrastructure failures
- War
- Government actions
- Third-party service outages
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Operator's jurisdiction, without regard to conflict of law principles.
Any disputes shall be resolved exclusively in the courts of the Operator's jurisdiction.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
17. Changes to Terms
We may modify these Terms at any time.
Continued use of the Service after changes constitutes acceptance of the revised Terms.
18. Entire Agreement
These Terms constitute the entire agreement between you and the Operator regarding the Service and supersede all prior agreements.
